Terms of Service

1. Agreement and Scope

CPAP Remarketing ("we", "us", "our") purchases surplus CPAP and BiPAP equipment from businesses and institutions. These Terms govern your use of this website and any inventory you submit to us. By submitting inventory or corresponding with us about a sale, you accept these Terms on behalf of your organization and confirm you are authorized to do so.

2. Business-to-Business Only

We deal exclusively with businesses and institutions. We do not purchase equipment from, or sell equipment to, individual patients or consumers. Nothing on this website is an offer to sell a prescription medical device to a consumer, and we provide no medical advice.

3. Your Representations

Each time you submit inventory, you represent and warrant that:

  • you are authorized to sell or transfer the equipment on your organization's behalf;
  • your organization owns the equipment outright, free of any lease, rental, lien, or other encumbrance;
  • you are not submitting patient information or Protected Health Information ("PHI"); and
  • the information you provide is accurate and complete to the best of your knowledge.

4. Offers Are Non-Binding

Submitting inventory creates no obligation for either party. Any price we quote is an estimate based on the information you provide and is not a binding offer. A purchase becomes binding only when both parties agree in writing to the specific quantities, condition, price, and delivery terms for that transaction. We may decline any inventory for any lawful reason.

5. Evaluation and Pricing

Pricing depends on model, run hours, condition, completeness, smoke exposure, and current market demand. We may request further information, such as a spreadsheet, serial list, or photographs, to complete an evaluation. If equipment materially differs from your description on inspection, we may revise or withdraw a quote before a binding agreement is reached.

6. Shipping, Title, and Payment

For accepted inventory, the written agreement for that transaction governs packaging, carrier, freight cost, insurance, payment method, and payment timing. Title and risk of loss pass as stated in that agreement. You are responsible for removing or sanitizing any patient-identifying material before shipment.

7. Regulatory Compliance

CPAP and BiPAP devices are regulated medical devices. Each party is responsible for its own compliance with applicable federal and state law governing the sale, transfer, and resale of such equipment, including any licensing or recordkeeping requirements that apply to it. Requirements vary by state and change over time.

8. Trademarks

ResMed, AirSense, AirCurve, AirMini, and AirFit are trademarks of ResMed. We are not affiliated with, endorsed by, or sponsored by ResMed. Those marks are used solely to identify the equipment we purchase.

9. Disclaimer and Limitation of Liability

This website and our services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability and fitness for a particular purpose, to the fullest extent permitted by law. To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising from your use of this website or the submission of inventory. Our total liability for any claim relating to a transaction will not exceed the amount we paid or agreed to pay for the equipment at issue.

10. Governing Law

These Terms are governed by the laws of the state in which CPAP Remarketing maintains its principal place of business, without regard to its conflict-of-laws rules. The state and federal courts serving that location have exclusive jurisdiction over any dispute arising from these Terms, and each party consents to venue there.

11. Changes

We may update these Terms from time to time. Changes take effect when posted on this page, and the date above will be revised. The version in effect when you submit inventory governs that submission.

We use reasonable administrative and technical safeguards to protect the information we hold. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
